Terms governing peaktrustrealty.com, our $118 flat fee MLS listing service, and our buyer representation services.
Please read these Terms and Conditions carefully before using peaktrustrealty.com or engaging Peak Trust Realty LLC. By using this website or purchasing a service through it, you agree to be bound by these terms.
Peak Trust Realty LLC is a licensed Florida real estate brokerage. Broker of record: Rogelio Rives, Florida Broker License #BK3512728; Brokerage License #CQ1072020. We offer two distinct services, described separately below. The terms that apply to you depend on which service you purchase.
Our primary service is a limited service MLS listing for Florida property owners, offered at a one-time flat fee of $118. There is one package and one price. There are no tiers, upsells, or additional fees charged by us.
This is a limited service listing. The following remain your responsibility:
Under our flat fee listing service, Peak Trust Realty LLC has no brokerage relationship with you. We do not represent you as your agent.
Under Section 475.278, Florida Statutes, a real estate licensee with no brokerage relationship owes you only: dealing honestly and fairly; disclosing all known facts that materially affect the value of residential real property and are not readily observable to the buyer; and accounting for all funds entrusted to the licensee. We do not owe you the duties of loyalty, confidentiality, obedience or full disclosure that a single agent owes a principal.
You will receive written notice of this no brokerage relationship together with your listing agreement.
Your listing is governed by a written Limited Service Listing Agreement between you and Peak Trust Realty LLC, which you sign electronically before the listing is published. Nothing on this website modifies that agreement. Where this page and the signed listing agreement differ, the signed listing agreement controls.
No listing will be entered into the MLS until the listing agreement has been signed and returned.
The $118 fee is earned when your listing is entered into the MLS, regardless of whether the property sells and regardless of who sells it. See our Refund Policy for the refund window.
You choose the term of your listing when you sign the listing agreement, and you may cancel at any time before it expires, for any reason, at no charge. If you cancel and later wish to list the property again, that is a new listing and requires a new $118 payment.
You are never required to offer compensation to a buyer's broker. Whether to offer compensation, and in what amount, is entirely your decision. Any compensation you choose to offer is established in a separate written agreement and, under applicable MLS rules, may not be advertised in any field of the MLS listing.
By submitting a listing you represent and agree that:
You represent that you own, or have permission to use, every photograph and all content you submit. Photographs taken by a previous listing agent, a hired photographer or a third party are frequently protected by copyright owned by that photographer, not by the homeowner — do not submit them unless you have the right to do so.
You grant Peak Trust Realty LLC a non-exclusive licence to publish, reproduce, distribute and syndicate the photographs and content you submit for the purpose of marketing your property, including through the MLS and its distribution partners, for the duration of the listing and any period required by MLS rules thereafter. You agree to indemnify us against any claim arising from content you submit that you did not have the right to provide.
We also represent buyers in new construction and resale purchases throughout Florida. In a typical transaction the buyer's agent commission is paid by the seller or builder at closing, so there is generally no out-of-pocket cost to the buyer. This is not guaranteed in every transaction; where a property does not offer buyer-broker compensation we will tell you before you proceed.
Representation begins only on execution of a written agreement between you and Peak Trust Realty LLC. Submitting a contact form or requesting a consultation does not create a brokerage relationship or any obligation on either party.
Payments are processed by Stripe, Inc. We do not receive, handle or store your full card number, and no card details pass through our servers. Your use of Stripe's checkout is additionally subject to Stripe's own terms and privacy policy.
The price for the flat fee listing service is $118 in United States dollars, charged once.

For any claim arising out of the flat fee listing service, our total liability shall not exceed the amount you paid us for that service. For any claim arising solely out of website use, our total liability shall not exceed $100. Nothing in these terms limits any liability that cannot be limited under Florida law.
All real estate services are performed in compliance with Chapter 475, Florida Statutes and the rules of the Florida Real Estate Commission (FREC). These Terms are governed by the laws of the State of Florida. Any dispute arising from your use of this website or our services shall be resolved in the state or federal courts located in Hillsborough County, Florida.
We may update these Terms at any time. Changes take effect on posting to this page with an updated date. Changes do not alter the terms of a listing agreement you have already signed.
